Este estudio analiza el artículo 146 del Código Orgánico Integral Penal (COIP) de Ecuador, esta trata sobre el homicidio culposo por práctica profesional equivocada. La mala praxis médica es un problema grave en el sistema de salud de Ecuador, y la interpretación inadecuada de este artículo ha generado confusión en los procesos legales relacionados. El objeto de la investigación es analizar la normativa del artículo 146 del COIP y las lagunas de interpretación jurídica para determinar la culpabilidad o inocencia de (...) los profesionales de la salud. Para ello, se emplearán métodos comparativos e históricos, que incluyen revisión bibliográfica, análisis de contenido del artículo 146. Los resultados esperados son demostrar las dudas razonables en la prueba del delito de mala praxis, resaltar la importancia de la bioética en los procedimientos legales. Este estudio busca contribuir a una mejor comprensión del marco legal y brindar ideas para la resolución de casos de mala praxis y homicidio culposo en Ecuador. (shrink)

In futsal there are two referees on the playing court and their capacity to respond to physical and physiological demands imposed during the game is essential for the success. The futsal characteristics such as size pitch, referees position and rules of games or type of league could impose specific physical efforts probably. The aim of this study were to analyze the physical demands of eight elite referees from seven matches of Spanish Futsal Cup 2020. The physical activity of each referee (...) during the match was monitored with a Local Positioning System, which was installed on futsal pitch where the matches were played. The data differences were evaluated as Paired-Samples T-Test procedure. The results revealed a similar total distance between halves. The zone 3 distance showed a significative decrease during the match in comparison to the first and second halves. The number of high-intensity acceleration and deceleration decreased in the second half of the match. Therefore, the use of the tracking device to monitoring physical performance provides knowledge of the specific activity profile from futsal referees. We used 7,415 advertisements published in Spain to analyze traits sought/offered by men and women from different age groups. Findings regarding age, socioeconomic status, and physical attractiveness requirements support evolutionary predictions about mate preferences. However, changes in trait preferences among women under 40 appear to be contingent on Spain’s socioeconomic transformation. Women under 40 seek mainly physical attractiveness in men, whereas those over 40 seek mainly socioeconomic status. The trait most sought by men in all age groups is physical attractiveness. (...) Traits sought and offered by advertisers may be conditioned by the personal situation of the advertiser. Mean age of advertisers (around their forties) and Spain’s social indicators suggest that the majority of advertisers have been unsuccessful in the mating arena at the conventional age. (shrink)

Los estudios destacan los problemas de la identidad latinoamericana, la intertextualidad, la multiculturalidad y la conquista; revelan su actualidad en el siglo XXI a través del mestizaje, las tradiciones culturales del Viejo y el Nuevo Mundo, y los otros mundos; y expresan, así, la necesidad de reconstruir un nuevo humanismo. Sanchez and Sanchez have selected, edited, translated, and introduced some of the most influential texts in Mexican philosophy, which constitute a unique and robust tradition that will challenge and complicate traditional conceptions of philosophy. The texts collected here are organized chronologically and represent a period of Mexican thought and culture that emerged from the Mexican Revolution of 1910 and which culminated in la filosofia de lo mexicano (the philosophy of Mexicanness). Though the selections reflect on a variety of philosophical questions, (...) collectively they represent a growing tendency to take seriously the question of Mexican national identity as a philosophical question--especially given the complexities of Mexico's indigenous and European ancestries, a history of colonialism, and a growing dependency on foreign money and culture. More than an attempt to describe the national character, however, the texts gathered here represent an optimistic period in Mexican philosophy that aimed to affirm Mexican culture and philosophy as a valuable, if not urgent, contribution to universal culture. Adults (more than 18 years old) are likely to reproduce the habits that they acquired during childhood and adolescence (from 6 to 16 years old). For that reason, teachers and parents have the responsibility to promote an active and healthy lifestyle in children and adolescents. Even though every school subject should promote healthy activities, Physical Education (PE) is the most important subject to foster well-being habits associated to healthy lifestyle during sport practice and other kinds of active tasks. Indeed, there (...) are many factors that influence the acquisition of healthy habits that should be taken into account when programs and activities are implemented in both educational and extracurricular context. In this sense, psychological and social factors are of utmost importance to achieve optimal experiences for an active and healthy lifestyle. However, due to the myriad of studies analyzing different factors in different contexts, there could be confusion when programs and pedagogical strategies are applied in educational or extracurricular contexts. The objective of this investigation is to analyze the state of art of the psychosocial factors which influence the engagement in physical activities and sport practice. The keywords used in this review were mainly: ‘Self-Determination Theory’, ‘motivation’, ‘Psychological need satisfaction, ‘physical activity and sport engagement’, ‘Elementary Education’, ‘Secondary Education’, ‘Physical Education’. The articles were selected according to the following criteria: (a) peer-reviewed original research published in international journals indexed in JCR or SJR, (b) published in English or Spanish, (c) about psychosocial factors which influence the physical activity and sport engagement, (b) in educational or extracurricular context. Research articles selected were found through nine databases. It was observed that physical activities and sport practice engagement are closely related to psychological factors. In particularly, intrinsic motivation was able to determine the active participation in any activity, including physical activity and sport practice during the implementation of Small-Sided Games and other kinds of pedagogical strategies (e.g., Pedagogical Models). Motivation was also closely related to flow state. Finally, these variables should be considered in order to organize effective programs to promote an active and healthy lifestyle in Physical Education classes. (shrink)

This paper presents the design, simulation, and experimental verification of the fractional-order multiscroll Lü chaotic system. We base them on op-amp-based approximations of fractional-order integrators and saturated series of nonlinear functions. The integrators are first-order active realizations tuned to reduce the inaccuracy of the frequency response. By an exponential curve fitting, we got a convenient design equation for realizing fractional-order integrators of orders from 0.1 to 0.95. The results include simulations in SPICE of the mathematical description and the electronic implementation (...) and experimental measurements that confirm them. Monte Carlo and sensitivity tests revealed a robust realization. Contrary to its passive counterparts, the suggested realizations significantly reduce design and implementation efforts by favoring resistors and capacitors with commercial values and reducing hardware requirements. The aim of this paper is to advance, within the framework of enactivism, towards a more radically embodied and situated theory of emotions and, in general, of affectivity. Its starting point is that of discussing the well-established notion of bodily resonance (Fuchs 2013, Fuchs & Koch 2014, Fuchs 2018) and the primordial affectivity approach (Colombetti 2014). I will incorporate John Dewey’s theory of emotions, and recent models and empirical finding from cognitive science on the relation between perception and bodily activity (...) (Azzalini, Rebollo & Tallon-Baudry 2019; Allen et al. 2019). The novel element proposed in this paper is taking into consideration the role of bodily oscillatory activity in the perceptual side of cognition through phenomena of relative coordination. This concept from dynamical systems theory allows for an enactivist view of emotions as temporal episodes triggered by a tension that affects the rhythmic interaction between brain, body, and environment. By defending the importance of this enacted rhythm, the body emerges as a truly active agent, gating and modulating affectivity during all the stages of the sensorimotor circuit from perception to action. The aim of this paper is to present a process-based ontology of art following John Dewey’s concepts of experience and rhythm. I will adopt a pragmatist and embodied point of view within an adverbialist framework. I will defend the idea of an artistic way of experiencing – a subtype of aesthetic experience – as something which allows us to assign the ontological category of art to an object or event. The adverbial features of this artistic way of experiencing will be (...) characterized as being rhythmic in nature. This goal will be achieved in three steps. First, I will explain and elaborate on the concept of adverbialism. Second, the importance of rhythm in experience will be taken into account through a close reading of Dewey’s philosophy and by incorporating the nuances of the Pre-Socratic idea of rhuthmos, as well as some recent findings about brain and bodily oscillations from cognitive science. Third, to conclude I will propose four necessary but not sufficient features of the rhythmic engagement enacted while an artistic way of experiencing takes place: a necessary degree of object or event awareness, a positive feedback dynamic, a loosening of the sense of agency, and being attentionally demanding. The focus of this paper is Mexican historicism. It has three objectives: first, to introduce English-speaking readers to the nature and history of Mexican historicism; second, to defend Mexican historicism against the charges of relativism usually raised against historicism in general and “Mexican” philosophy in particular; and third, to argue for what I call the transcendental, or alternatively, “liberatory,” nature of Mexican historicism—a nature with philosophical and political consequences. The hope is that by making the clarifications and determinations made here, (...) the tradition of Mexican philosophy, of which Mexican historicism is a key moment, may find its place in the increasingly pluralistic US philosophical landscape. The Coronavirus Covid 19 pandemic has produced terrible effects in the world economy and is shaking social and political stability around the world. The world of sport has obviously been severely affected by the pandemic, as authorities progressively canceled all level of competitions, including the 2020 Olympic Games in Tokyo. In Spain, the initial government-lockdown closed the Sports High-performance Centers, and many other sports facilities. In order to support athlete's health and performance at crises like these, an online questionnaire named (...) RECOVID-19, was designed to assess how athletes were living their lives during such periods of home confinement. The main purpose of the questionnaire was to assess the impact of prolongued confinement on athlete's psychological, emotional, and behavioral performance. One thousand, two hundred forty-eight athletes participated in the survey. They had the fllowing characteristics:, who compete at National and International level. Results showed that during the confinement period, those athletes who lacked motivation reported a higher level of stressful thoughts, more behavioral problems, and greater emotional upheaval. However, those athletes who accepted confinement measures as necessary, and were in favor of respecting the rules of social isolation, fostered positive emotional states such as feelings of friendship. In addition, the availability of some sport equipment together with the ability to continue some training, were protective factors against emotional stress, lack of motivation and behavioral problems; and they were associated with greater respect for, and adherence to, confinement rules. Gender differences, tested by multigroup analysis, revealed that coping activities were more often associated to negative emotional states among women, whereas the ongoing availability of training information and future conditions were equally protective factors for both genders. This study also showed that receiving coaching, support and completing frequent training routines seem to be valuable tools to prevent or reduce some of the harmful effects of isolation on athlete's emotional well-being. The conclusions derived from this research would possibly help sport authorities to design supporting policies and plans to support athletes and trainers in future disruptive health crises. (shrink)

This paper traces the concept and phenomenon of generosity from Aristotle to Emannuel Levinas and beyond. The question motivating this investigation is: must the generous act be restricted by a rational calculation of correct, or prudent, giving? Answers to this question vary. Aristotle and Kant would answer in the affirmative, while Emerson and Levinas would not. The bulk of this paper is dedicated to Levinas's characterization of excessive generosity as a condition for the fundamental ethical relation, namely, the generous welcome (...) of the Other. I end by considering the phenomenon of generosity from the point of view of the mid‐20th century Mexican philosopher, Emilio Uranga. (shrink)

En 1941, deux ans après la fin de la guerre civile, le gouvernement espagnol a signé un accord avec le St-Siège par lequel le Chef de l’État, le Général Francisco Franco, intervenait directement dans la nomination des évêques et des archevêques diocésains. L’accord a été inclus dans le Concordat de 1953, qui a scellé les relations de coopération entre les deux États. Après le Concile Vatican II, le pape Paul VI a personnellement demandé au Général de renoncer à ce privilège, (...) mais Franco refusa, subordonnant son renoncement à une révision totale du Concordat. Le Roi Juan Carlos Ier a renoncé à ce privilège quelques mois après son couronnement ; ainsi les relations Église-État, compliquées pendant les dernières années du franquisme, se sont normalisées.In 1941, two years after the end of the civil war, the Spanish government signed an accord with the Holy See under which the Head of State, General Francisco Franco, intervened directly in the nomination of diocesan Bishops and Archbishops. The accord was included in the Concordat of 1953, which cemented cooperative relations between the two States. After Vatican Council II, Pope Paul VI personally asked the General to renounce the privilege, but Franco refused, linking his renouncement to a total revision of the Concordat. ...In what follows I lay out Husserl's theory of epistemic justification as he sketches it in Part IV of 'Ideas 1', especially in the section he appropriately titles the "Phenomenology of Reason," understood here to present a phenomenological analysis of how reason is given, namely, how reason manifests itself in conscious life. My claim is that Husserl's "phenomenology of reason," by clarifying the ways in which the "legitimizations of reason" take place can be ultimately understood as a theory of epistemic (...) justification. The theory of epistemic justification discused here is a phenomenological account of the process whereby the thinking subject comes to regards particular beliefs as true and can give reasons to support this claim. The objective of this article is to analyse cultural influences when French companies cooperate with Mexican companies (subsidiaries of the French, established in Mexico) in the field of automotive manufacturing. An OEM supplier and a final assembly plant were selected to perform the study. Interviews with the workers, supervisors and managers have been performed. Case studies were collected in order to analyse the problems and to illustrate technical as well as cultural solutions. The analysis showed that important differences and coincidences (...) in the manufacturing solutions could be explained from the cultural (French and Mexican) standpoint. The conclusions integrate some recommendations for French and Mexican companies that are in actual cooperation or that are planning to globalise in the corresponding countries. (shrink)

Ten years ago National Geographic magazine reported that the Loma Linda Seventh-day Adventist population is one of the communities in the world that lives longer and with a higher quality of life thanks in part to the biological benefits of a vegetarian diet. Along with National Geographic, other media outlets have reported since then that the Adventist religious community considers a plant-based diet a very important factor for a healthy lifestyle. Adventists have been promoting this type of diet worldwide for (...) more than 150 years. This article is an attempt to understand from a social-scientific perspective the origin of the importance they lend to diet and see whether this helps explain why approximately 150 years after the founding of the church, diet remains crucial for Adventists around the world. The conclusion proposed is that Adventists understood the adoption of a plant-based diet as a special divine instruction in order to nourish their new identity as a special people differentiated from the rest of society. This was possible through a desecularisation of diet that placed food in the moral category of the Adventist belief system.Keywords: Seventh-day Adventist Church; vegetarian diet; religion; health; desecularisation; identity. Deception scholars have argued that increasing the liar’s cognitive system artificially can produce deception cues. However, if too much load is imposed the truth tellers’ performance can also be impaired. To address this issue, we designed a veracity task that incorporated a secondary task to increase cognitive load gradually. Also, because deception has been associated with activity in the inferior frontal cortex (IFC), we examined the influence of transcranial direct current stimulation of the IFC on performance. During stimulation, participants truthfully (...) or deceptively indicated whether each of a number of statements shown on screen was true or not. Higher load decreased recall but not general compliance or response times (RTs). Truthful trials yielded higher compliance rates and faster RTs than deceptive trials except for the highest load level. Anodal right stimulation decreased compliance in truthful trials when participants were not overloaded. Truth telling was more vulnerable to cognitive load and tDCS than lying. (shrink)

Many pragmatist and non-representational approaches to cognition, such as the enactivist, have focused on the relations between actions, affectivity, and habits from an intersubjective perspective. For those adopting such approaches, all these aspects are inextricably connected; however, many questions remain open regarding the dynamics by which they unfold and shape each other over time. This paper addresses a specific topic that has not received much attention: the impact on future behavior of not fulfilling possibilities for social interaction even though their (...) fulfillment is desirable within a given context. Inspired by Gibson’s theory of affordances and Dewey’s account of habits, these situations will be characterized as events where an agent does not act upon an inviting affordance for social interaction due to a conflict which he or she experiences between given concerns, needs, and social norms. This conflict leads to a sense of unfulfillment that may eventually bring about a crisis and revision of habits. Through specific examples, this work presents the potential impact of the connection between affordances, habits, and affectivity on everyday situations. It therefore represents an exploration of the common ground between pragmatism and enactivism and an attempt to contribute to a process-based approach to social interaction. (shrink)

Nos hemos acostumbrado a considerar como normales una serie de situaciones de injusticia extrema que son fuente de miseria y esterilización de las posibilidades humanas de vastos sectores de la población mundial. El presente artículo trata de mostrar que tales situaciones no resultan de la violación de principios éticos fundamentales por parte de algunos individuos u organizaciones aisladas, sino, justamente, de la aplicación de los criterios éticos que prevalecen hoy en la práctica económica y política. La vigencia de éstos se (...) debe a que convienen a los intereses de los países y grupos económicos que dominan el escenario global, quienes los aprovechan de manera ideológica para mantener su poder, al margen del perjuicio que causan al desarrollo de las sociedades menos avanzadas económicamente. El texto concluye haciendo énfasis en la necesidad de replantear los criterios éticos que sirven para sustentar las decisiones económicas en el marco de la globalización actual. (shrink)

This paper explores various notions of aesthetic affordance recently developed through embodied, situated and enactive approaches to aesthetic experience by Maria Brincker and Shaun Gallagher, and the similarities and differences between them and the idea of affective affordance put forward by Joel Krueger and Giovanna Colombetti. This discussion is a way to try to offer some answers to the question of what aesthetic affordances particularly afford compared to affective affordances. I will focus on the affordances that we perceive during various (...) aesthetic experiences in which we find ourselves more moved by the object, event or person(s) causing the experience than we had anticipated. I will argue that these experiences emerge as opportunities to carry out an active exploration of aspects of the narrative self that we feel is related to features of the experience; and that one particular brain network likely to be involved in these experiences – i.e. the default network – might help us to understand how these experiences meaningfully change our relationship with ourselves and with the social context of which we are a part. This book introduces readers to central concepts and ideas in Mexican philosophy. Couched in stories and anecdotes from the author's life, the book offers these concepts and ideas as orientations, recommendations, or exhortation for navigating today's world. The structure and the style of the book aims at making these accessible to both specialists and non-specialist or anyone who may have had some experience with contemporary forms of marginalization, alienation, objectification, or any of the various forms of dread and accidentality familiar (...) to modern life. This, the author thinks, is most of us. Narrowing down the scope of the tradition, the author draws from the history of Mexican philosophy in the 20th century, as it is at this time that Mexican philosophy comes into its own. The book begins with two short introductions, one is an introduction philosophy in Mexico, the other to Mexican philosophy. Here, readers are introduced to Alfonso de la Veracruz, who offered the first philosophy course in the Americas in 1540 in the monastery of a small town in Michoacán, Mexico. From there, it presents four main themes from Mexican philosophy that recur in the philosophical literature. The remainder of the book serves as a "guide" for living a better, more fulfilling life. The main characters in what the author considers an uncontroversial retelling of Mexican philosophy are Antonio Caso, Samuel Ramos, Emilio Uranga, Leopoldo Zea, Jorge Portilla, Rosario Castellanos, Elsa Cecilia Frost, and, of course, persons in the author's own life.
